4. SELLER WARRANTIES

Seller warrants that the Property is free of all liens and that taxes are current as of the effective date of this Contract.
Seller warrants that the Property is available to the Buyer as of the Contract’s effective date.
Seller may restrict timber removal to only areas necessary for placement of a dwelling or structure until the full purchase price (including interest, if applicable) is paid.
Seller will retain title (Warranty Deed) until the Property is fully paid. Seller warrants the title will remain free from loans, liens, or encumbrances during the payment period.
Upon full payment, Seller will provide Buyer with a marketable title.

5. TAXES

Seller will pay annual property taxes during the contract term.
Buyer agrees to reimburse Seller for the taxes within 60 days of the tax due date.
Failure to reimburse taxes within the allowed timeframe constitutes default, and the entire remaining balance will become due within 30 days.

6. DEFAULT & GRACE PERIODS

Monthly Payment Grace Period:
Buyer has a 5-day grace period after the due date. Payments received after this period will incur a $25 late fee.
Default for Non-Payment:
Buyer is in default if a monthly payment is 35 days late.
- Seller will notify Buyer of default by email.
- Buyer has 30 days from notice to cure the default by bringing payments current.
- Failure to cure results in foreclosure, and Buyer forfeits all rights, interest, and payments made.
Buyer must maintain a valid email address on file for default notices.

7. MISCELLANEOUS

Assignability: Seller may assign this contract. Buyer may not assign without Seller’s written consent.
Governing Law: This Contract is governed by the laws of the state in which the Property is located.
Entire Agreement: This Contract constitutes the entire agreement between the parties.
Amendments: Any modification must be in writing and signed by both parties.
